This New year is turning out really right πŸ˜‚πŸ˜‚πŸ˜‚. Posted on Facebook by Ava Jhamin / Trinity Aironaut both accusing owners, publishers and editorsΒ  of January Issue of Kultivate Magazine – Johannes1977 and Eleseren Brianna of stealing one ofΒ  the images previously published in the October issue of Diversity Magazine – Publisher Ava Jhamin. Below is the image stolen and a lengthy chat conversation on Facebook which we couldn’t screen grab.. So hurry read all the juicy speech before it get deletedΒ  πŸ˜‚πŸ˜‚πŸ˜‚.

Image Blatantly Stolen

They say imitation is the sincerest form of flattery, but there is a big difference between Imitation and outright theft of one’s image. This is exactly what the Magazine Kultivate did with an image I was hired to create for the October issue of Diversity Magazine ( Publisher Ava Jhamin) located here: https://issuu.com/…/…/l_amour_diversity_magazine_iss_8_oc/38. In the January Issue of Kultivate (Owners, Publishers and Editors Johannes1977 and Eleseren Brianna) here: https://issuu.com/…/docs/kultivate_magazine-january_201…/226 you will see a very poor quality of my image literally stolen via print screen from my Flickr page. They were not given permission to use this image, nor were they given an original copy, from me, to use. They did not download it from my page as that is prevented via my settings. They did not ask to use the image or warn me that they were. It is not and never has been their property to use. It was actually Diversity Magazines property. For the record, beyond being in their group which I have since left, I never worked on or for Kultivate. I do not take credit for the poor quality of their stolen image.
As a photographer in SL, our images are very important to us. It is our product and using them without permission or recompense is by definition stealing. Belonging to a group is NOT an unspoken right to troll our Flickr pages and take what you please. Putting my Name to an image as poorly defined as this Damages the Magazine but more importantly to me, it DAMAGES MY REPUTATION AS A PHOTOGRAPHER!
In the real world, an issue like this would bring about legal action. Any honorable Magazine would know this behavior is deplorable. If a Magazine doesn’t have the talent to create their own work then they should close their doors or hire the people they need to do the work, the one thing they should never do is live off the backs of other Creators work.

  1. I’m sorry people, but OMG was this an issue that was made out of NOTHING! What I really don’t get is if you did a shoot for them why they didn’t have the original pic to put it up instead of downloading it at poor quality. IDK where you people think you get off saying the photographer owns they own art if they are hired. NO THEY DO NOT. Not in RL they don’t. You people are not this stupid??
    Another thing, if they only thing you can grab out of thin air is that fact that she copied that backdrop you petty as hell and you know it. Give me a damn break with that shit. Fuck me you people are fucking stupid.

    • If you read… the post… the artist was commissioned by one magazine, and then the image was used by a DIFFERENT magazine. The artist is not saying “Omg I own this they stole it.” They’re saying that the magazine who ORIGINALLY COMMISSIONED the image owns it, and that Kultivate stole it. Before you call people stupid, you might want to read.

  2. The more you look at it the more you can see how crappy of an edit it was. Near the hand with the bracelet if you look at the leaves close to it you can see they are cut off at a slant. Looks like she just grabbed them off the original picture and tossed them back on and tried to edit them over her avatar. More proof of that is the leaves that are pasted over her dress have a horrible edge around them. The original leaves that was used on the original pic she stole were not like that and they didn’t have the yellow edges that look so choppy. She just did a crappy job of trying to copy and paste with a bit of editing to remove the background when she put the leaves back on over her avi. Just a shit job overall.

  3. I would simply like to know how the photo came to be published in Kultivate magazine. It was removed and a statement issued about it being stolen work but before that was uncovered, how did any image even manage to make it into the published magazine without proper usage permission in the first place? Kultivate needs to get a good proofreader and fact-checker.

    you go to Facebook to gripe that your bike has been stolen
    someone else sees your photo of said stolen bike and recognizes it as one that was stolen from someone else

    now change Facebook to the police
    and the police are going too………

  5. That’s ok I have screenshots from flickr before she mentioned the original artwork and after she was caught and added the credit at the end. inertia Rose will have those.

      She did not do any of that. She did not provide a link to the license. She claimed it as her own. Even said it was someone else’s property and not the actual creator’s property. She did not mention the changes on the flickr page that she blasted her BS on. She did not credit the original creator until called out on it. She cropped out the original creator’s credit mark on the image.

      She distributed it. Plain and simple she’s caught.

  6. Careful Trinity is deleting comments because she’s edited what she wrote to finally show credit even though she CROPPED out the actual credit. Let it be known she only added credit after she was caught.

      • Uhh yeah she did. I had my comments deleted twice. And blocked from her pic. So yeah I think I know what i’m talking about. She got called out on not crediting the original creator. And since I see a screenshot of her facebook from when this all started and no credit to the creator there also it truly shows that she was not crediting at all. So unless you are me and Trinity then you have no clue what you are talking about when it comes to the deletion of my posts on the flickr.

  7. Oh, how the plot thickens: John/Eles STOLE Trinity’s STOLEN photography. This is hilarious and pathetic. Why hasn’t anyone commented on how John can’t even spell their magazine name right?     that is IF we assume Trinity Aironaut is Inertia Rose from Deviant Art
    cause if Trinity is not then SHE stole someone else work that licensed under a
    Creative Commons Attribution-Noncommercial-No Derivative Works 3.0 License.

    Granted Inertia Rose’s DA profile says she is from Canada – and Trinity’s says she is from washington DC

    So it seems we can probably safely assume the person crying about stolen work in a Facebook diatribe, had already stolen the work from someone else on Deviant Art and just move on after notifying the person that created the original artwork of course.

    and just FYI – there is NO such thing as altering something enough for it to be yours – it is always a derivative piece of work

    • The leaves are free to use a stock photo, the grasses were added and she also said feel free to use. The image of the woman which was another element was not used. I think people are forgetting backgrounds are backgrounds just like in this case. If you would of done your homework on the site you would of seen that she gave permission to use.

        the artwork has a CC BY-NC-ND license listed on the page you might want to go read what that license allows before you post i.e. DO your homework

        Yes, I did use part of another design as my background, but it was a background only. Most of us find our backgrounds from the web. No doubt if you look at many of the Pics on Flickr or in Johns and Eles’s Magazine you’ll find many backgrounds taken from the web.

        clipping out a body and using the “background” as 90% of what you are calling “your work” is not ethical when it has a license that does not allow for it – actually not ethical is the wrong phrase it is NOT LEGAL

        You have your own work marked “as all rights reserved” – but you don’t follow someone else’s license -get a grip, you are complaining about your work being stolen that YOU stole in the first place

        • It was linked as requested….Once more the leaves were a stock photo, and the grass was added and also could use. also added more leaves as you can see on and around the gown, different lighting and was a background. She also as requested did as they required.

            there are several reasons an artist might do this – a common one being that they do not have transferable rights to allow you to have anymore rights than they have given you – or they just do not want dickheads stealing their work

        • She followed all the rules in taking the background that is all I was getting across…it wasn’t stolen art…but when you go and take a gyazo shot of someones locked flickr page what is that…..the whole premise of this was that….We work hard to make sure we follow the licensing agreements. We need to look at what this was about not harp on legalities as we did what we were supposed to do as far as taking our editorial shots.

          • It was stolen. She cropped out the actual credit on the picture. It was meant for desktop backgrounds. She only added credit on her flickr after she got called out on it. Which now she keeps deleting if a comment is mentioned about that fact. She needs to own up to what she did and maybe this would die down.

  9. Ava Jhamin is the biggest attention whore in Second Life. She does nothing but play SL for 14 hours a day, she even schedules her real life around Second Life. Her house in real life from her former kid avi, who visited her home, “is an absolute mess, while Ava, who is over 300 pounds, sits at home and in SL all day long, taking horrible Flickr images.” It only makes sense she would stir up trouble, along with her flunkies Trinity Aironaut. Hey Ava how many shows have you had in 2015? How many models have signed up for MMI? Hey Trinity how come the only agency where you can get work is at L’Amour aka L’Shitty. Compounding that theft with neglecting to ask for the image from the person who posted it, and not even advising them you took it and then posting it in your insipid magazine = unethical. Are you “unbiased” when you say SLEnquirer will publish anything because they have no standards, even though you regularly publish your own personal issues with other people as if it’s news we need to know? Are you “unbiased” when your staff is caught fraternizing with your enemies, people they have no reason to hate other than because you hate them and say they should too? I looked him up, he has a website, with contact info … I wonder if he would be unbiased about your theft? Funnily enough, even if it WAS you (which it isn’t) you didn’t get permission to use it, you didn’t give him credit for the photo, or post a link of attribution …. hmmmm, unbiased …. no I don’t think he’d be unbiased about that ……

              • I am no fan of the Kultivate/Windlight bunch..but I can see why they would ban you Thea, you seem 100% unstable, insane, and ignorant. You have offered nothing but angry PMS filled rants, and demonstrated a great deal of obsessive compulsive behavior. Ask yourself if these people are really worth your time, words, and effort? It’s just Second Life, let it go and move on. The more you continuously take the time to write long winded PMS filled rants, the more psychotic and unstable you look. Plus you are just giving more land and sim owners reasons to ban you from their property.
